Expert Witness

Brendan Merry & Partners have experience of acting as Expert Witness on construction matters in Conciliation and Arbitration proceedings and in the High Court.

The Expert Witness is a person whose qualifications and expertise give an added authority to opinions or statements given or made by him within his area of expertise when acting for a party at a Conciliation, an Arbitration or in Court. The purpose of expert evidence is to assist the tribunal in reaching an independent conclusion on a matter. He provides impartial evidence within the area of his expertise and can give his opinion as well as factual evidence.

The duty of an Expert Witness is to the tribunal to whom the expert evidence is being given. This duty overrides the contractual duty to the Client. The Witness carries out investigations to enable him to set out the facts fully and to give truthful, impartial and independent opinions covering all relevant matters without bias to the appointing party.
